1. Agreement to Terms

By accessing or using MedBFit's services, mobile application, or website (collectively, the "Services"), you agree to be bound by these Terms of Service and all applicable laws and regulations.

Last Updated: These terms were last modified on December 1, 2024. We reserve the right to update these terms at any time. Continued use of the Services after changes constitutes acceptance.

2. Eligibility Requirements

To use MedBFit, you must:

• Be at least 16 years old (or have parental consent)
• Be physically capable of participating in fitness activities
• Have no medical conditions that prohibit exercise (or have medical clearance)
• Provide accurate and truthful information
• Have the legal capacity to enter into contracts
• Not be prohibited from using the Services under UAE or international law

3. Account Terms

Account Creation

• You must provide accurate, current, and complete information
• One account per person (no shared accounts)
• You are responsible for maintaining account security
• You must immediately notify us of unauthorized access
• Username must not be offensive or infringe on trademarks

Account Responsibilities

You are fully responsible for:

• All activities under your account
• Maintaining confidentiality of login credentials
• All content posted through your account
• Compliance with these Terms and applicable laws

4. Services Description

What MedBFit Provides:

• Personal Training Platform: Connect with certified fitness trainers
• Custom Workout Plans: Personalized exercise programs
• Nutrition Guidance: Meal plans and dietary advice
• Progress Tracking: Monitor fitness metrics and achievements
• Video Consultations: Remote training sessions
• Community Features: Forums and group challenges
• Educational Content: Articles, videos, and tutorials

Service Limitations:

• Services are provided "as is" without guarantees of specific results
• Availability may vary based on trainer schedules
• Features may be added, modified, or removed at our discretion
• Internet connection required for all services

5. Payment & Billing

Subscription Plans:

• Basic Plan: AED 299/month - Access to app and basic features
• Premium Plan: AED 599/month - Includes 4 personal training sessions
• Elite Plan: AED 999/month - Unlimited sessions + nutrition coaching
• Pay-Per-Session: AED 150-300 per session (trainer dependent)

Billing Terms:

• All prices in UAE Dirhams (AED) unless specified
• Subscriptions auto-renew monthly unless cancelled
• Payment due at the beginning of each billing cycle
• We accept Visa, MasterCard, Apple Pay, and Google Pay
• Failed payments may result in service suspension
• Prices subject to change with 30 days notice

Refund Policy:

• 7-day money-back guarantee for first-time subscribers
• No refunds for partially used months
• Session cancellations subject to 24-hour policy
• Refunds processed within 5-10 business days

6. Cancellation Policy

Training Sessions:

• 24+ hours notice: Full credit or rescheduling available
• 12-24 hours notice: 50% credit issued
• Less than 12 hours: No refund or credit
• No-show: Full session charge applies
• Trainer cancellation: Full refund or free rescheduling

Subscription Cancellation:

• Cancel anytime through app settings or email
• Cancellation effective at end of current billing period
• No partial month refunds
• Access continues until end of paid period

7. User Conduct Rules

Prohibited Activities:

You agree NOT to:

• Harass, abuse, or threaten other users or trainers
• Post inappropriate, offensive, or explicit content
• Share false or misleading health/fitness information
• Impersonate others or misrepresent qualifications
• Use the platform for illegal activities
• Attempt to hack, reverse engineer, or disrupt services
• Spam or send unsolicited marketing messages
• Share copyrighted content without permission
• Create multiple accounts or use bots
• Violate any applicable laws or regulations

8. Content & Intellectual Property

MedBFit Content:

All MedBFit content including logos, text, graphics, videos, and software is protected by copyright and trademark laws. You may not:

• Copy, modify, or distribute our content without permission
• Use our trademarks or logos without authorization
• Scrape or data mine our platform
• Create derivative works based on our content

Your Content:

By posting content, you grant MedBFit:

• A worldwide, non-exclusive, royalty-free license to use your content
• Permission to display your progress photos and testimonials
• Right to use your content for marketing (with your consent)
• Authority to remove content violating our policies

9. Disclaimers & Limitation of Liability

Service Disclaimers:

• No guarantee of specific fitness results
• Services provided "AS IS" without warranties
• We don't guarantee continuous, uninterrupted service
• Not responsible for user-generated content
• No liability for third-party services or links

Limitation of Liability:

TO THE MAXIMUM EXTENT PERMITTED BY LAW, MEDBFIT'S TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID IN THE LAST 12 MONTHS. WE ARE NOT LIABLE FOR INDIRECT, INCIDENTAL, OR CONSEQUENTIAL DAMAGES.

10. Termination

Termination by You:

• Cancel subscription anytime through the app
• Request account deletion via support@medbfit.com
• Data deleted within 30 days of request

Termination by MedBFit:

We may terminate your account for:

• Violation of these Terms of Service
• Illegal or fraudulent activity
• Non-payment or payment disputes
• Abusive behavior toward staff or users
• Extended inactivity (12+ months)

Effect of Termination:

• Immediate loss of access to all services
• No refund for unused subscription time
• Deletion of personal data per privacy policy
• Survival of sections on liability and disputes

11. Governing Law & Disputes

These Terms are governed by the laws of the United Arab Emirates. Any disputes shall be resolved through binding arbitration in Dubai, UAE. You waive any right to jury trial or class action lawsuits.
